Once again, OOIDA, has been successful in having a Bill introduced in Congress that would mandate brokers and carriers who use owner operators to pay and disclose the fuel surcharge in all contract documents with carriers. 

S. 2910, written by the Owner Operator Independent Drivers Association staff, and introduced by Senators Olympia Snowe (R-Maine) and Sherrod Brown (D-Ohio) is a direct attack on shippers and members of the third-party logistics industry. 

Not only does the bill call for the fuelsurcharge disclosure, it is also an attempt to have the federal government regulate your margins.

Further, if the bill becomes law, complaining carriers would have a private statutory right of action against brokers, forwarders and carriers who use owner operators.  This means that complaints would not need to be filed with the federal Surface Transportation Board, Federal Motor Carrier Safety Administration or the Department of Transportation – they would just threaten to sue you!

OOIDA will be able to collect complaints and file lawsuits against allegedly non-compliant brokers, forwarders and carriers.  In addition, the bill permits attorneys fees to be recoverable as part of the costs of the action.

• Shippers, carriers and brokers who run businesses in their state, employing _____ number of employees and engaging thousands of motor carriers per year.

• Without brokers and other 3PLs, small motor carriers could not survive in the dynamic market place.  Brokers and 3PLs are the sales agents for these carriers so that they can operate and find loads wherever they are located.

• The large carriers are not calling for re-regulation of the industry.  In fact, ATA also opposes regulation of fuel pricing.

• OOIDA seeks government regulation, rather than the competitive free-market to provide opportunities for their members.

• If Congress is truly concerned about the price of fuel, it should allow increased exploration of oil in the United States.
